Our lawyer Azhari wrote these two letters for us which = have never=20 been mailed yet.
Bp. Azhari refused to send these letters using = his own=20 letterhead and designed the report to KPK as to be done by me and = the=20 report to Jaksa Agung (High Prosecutor in Jakarta) as Sang Ayu's = personal report=20 to be signed by her.
I think this is too dangerous for Sang Ayu to = do and so=20 I write and report on her behalf!

I had these two letters = translated to=20 English and I confirm their statements and facts being true.
I attach = both=20 these letters to this email and I take personal responsibility for their = content!

I am = fighting these=20 criminals with all means I have with all friends and allies I can = gather.
I=20 am fighting for the security and future of my family and for all the = people=20 of Indonesia, for everyone = who lives=20 in this beautiful country.

We need = full=20 transparency of accounts and activities of the government, of NGOs and = of=20 businesses if we want to fight and minimize corruption effectively- if = we want=20 to be able to help protecting citizens from corrupt and thus criminal=20 officials.

 

And no, I = did not=20 violate any law that I am aware of and it's most reasonable to assume = the=20 police is chasing us only because someone has them on his payroll. = This=20 could be one of our local ISP competitors who considers it = cheaper to pay=20 police to break the law than to improve services and who does not care = to=20 break the law and to traumatize and damage other fellow human=20 beings.

Most of = my business=20 friends say this is a "business problem" (they mean someone pays = corrupt=20 officials to give someone else a lot of trouble) and I subscribe to = this point=20 of view as such things are not unheard of in Indonesia or=20 elsewhere.

 

And what = about the=20 role of the media?
Bali TV, Denpasar Post, Radar Bali and others = who=20 published what Police PR told them, they make me very = sad.

They = published=20 without any investigation on their own, without any quality=20 control.

They just = reported=20 lies and false assumptions, ignoring presumption of innocence, = ignoring human=20 rights of persons named, ignorant of the damage they are=20 doing.
Indonesia has a free = press now, but=20 a free press has responsibilities.

  1. cv. Candi = Internet never=20 started ISP business to date=20
  2. When police = asked for=20 cv. Candi Internet's ISP license, police has been shown a = notarized=20 exclusive franchise agreement between PT. Pasifik Lintas Buana = (VIPNET), = who are=20 holding an operational national ISP license, and cv. Candi=20 Internet.
    Such franchises are common in Indonesia, = IndoNet is one=20 of the national ISPs operating mostly through franchise=20 partners.=20
  3. On October 23, = 2004,=20 police invaded our office and confiscated a satellite modem = plus a=20 router worth about US$ 8,000 by force and by threat of arrest = if we=20 would resist their demands.
    Police took our equipment just = minutes=20 after they looked at our franchise agreement for the first = time, which=20 they declared being illegal.

    We have been told by = various=20 lawyers that police ignored and abused the law by sweeping our = office=20 the way they did, by refusing to seriously investigate the = legality of=20 our franchise agreement, by confiscating equipment without = having any=20 court order and by the way investigations were=20 conducted.=20
  4. A few days = after the=20 sweeping, Detik magazine published two reports about this = sweeping=20 condemning it as illegal, as they claimed amongst other = statements,=20 that police had no right to investigate ISP licenses without=20 authorization by DirJen PosTel, the Jakarta based governmental = department=20 in charge of licensing.
    Police complained with us that we = informed=20 the media -which we did not- and told the Bali Media plain = lies about=20 their subjects of investigation via police PR department on = October=20 29.
    They told us that "this was their revenge" and we = should not=20 contact the media again, else we would get into real = trouble.
    Our=20 lawyer unsuccessfully investigated at Polda Bali who was = responsible=20 for the press release.
    The PR department of Polda Bali = declared=20 they never informed the press and so did the department of = ResKrim=20 which is responsible for the ongoing=20 investigations.
    Today, on Sunday, April 10, = 2005,=20 Bali = TV=20 broadcasted a report about police investigations against cv. = Candi=20 Internet.
    Two police officers made false statements against = us and=20 the results of their investigation: Tri Kuncoro and = Idodo.
    Both of=20 them were involved from the beginning and participated in the = sweeping=20 from October 23.
    They are members of the "Bali Cyber Crime = Squad"=20 and well known by unlicensed ISPs here on Bali.
    Earlier this year Mr. Idodo = was on Bali=20 TV as investigative specialist for abortion in a popular case = labelled=20 "Kasus Aborsi Dr. Gigi".

    In January 2005, we were told = by our=20 lawyer, that our case has been moved to the prosecutor's = office, then=20 back to police asking them to "find something else", as the = prosecutor=20 admitted that the "case was week" but police would "loose = their face"=20 if the case was to be dismissed.
    My lawyer informed me in = March=20 that the case has moved to the prosecutor again and is out of = police=20 hands now.
    He said the prosecutor told him that he was = determined=20 to bring the case to court, but on which charges our lawyer = could not=20 find out.=20
  5. Since October = 23, 2004=20 cv. Candi Internet was effectively blocked from starting our = new ISP=20 business as planned.
    This is not the place or time to make=20 statements If there were any requests for money from police or = prosecutors.=20
