It was a case of "market cleaning": Who paid the bills??? - The smoking gun points to German MegaCon SIEMENS who signed
a contract for wireless technoloy worth €330 million with Telkom Indonesia in October 2004!
Bali High Courtfully rehabilitated Candi Internet and my wife Sang Ayu on December 6, 2005. Prosecutor Suhadi filed revision with Indonesia's Supreme Court in Jakarta.
His only argument for revision is that Bali's High Court did not share the attitude of police, prosecution and Bali District Court who jointly and arbitrarily destroyed our business and livelihood.
The case against us was initiated by officers from "Bali Cyber Crime Squad" in October 2004.
The Chief of this squad is Lt. Tri Kuncoro, who has never handled any IT case before and who was reported for alleged extortion and corruption by other persons already.
Chief Tri Kuncoro became famous on Bali when he handled a investigations against a dentist charged with illegal abortions early 2005.
He is infamous for handling another case of alleged corruption and extortion against Mark Austin.
Police moved the case against us in Janurary 2005 to Bali's Chief Prosecutor Ida Bagus Wiswantanu, whom I reported to KPK in April 2005 after he blackmailed us in January 2005 and again in March 2005.
Wiswantanu gained international fame while he handled the case against Australian Schapelle Corby who was accused of trying to smuggle Marihuana into Bali in October 2004. In May 2005 International and Indonesian media reported claims that prosecutor Wiswantanu asked money in exchange for not applying the death sentence as he already announced he would, but only life imprisonment for Schappelle Corby. He finally applied for life imprisonment only.
Following my report to KPK, prosecution produced backdated documents moving the case against my wife and our company to Bali District Court after they were informed that an investigation for alleged corruption against police officers has been ordered by the President's anti-corruption commitee KPK.
Henceforth our case was handled by prosecutor Suhadi who finally arrested Sang Ayu on June 15, 2005 based on his false statement that she was ignoring court summons letters for three months.
Prosecutor Suhadi gained international fame when he handled the case against Australian Michelle Leslie, who was arrested 2005 because two ecstasy pills were found in her bag.
International media reported about this case and reported about rumors that briberies of some AU$ 600,000 had been paid to get Michelle Leslie finally released not after a max term of 15 years for drug possession. but after 3 month only for drug usage.
In September 2005 Bali District Court sentenced Sang Ayu to 5 month imprisonment for allegedly using uncertified telecommunications equipment.
On December 6, 2005 Bali High Court released Sang Ayu as innocent on all charges and expressively granted her the right to get fully rehabilitated.
We were told to expect the Supreme Court in Jakarta to queue our case for at least 24 month.
During this time we can not file any damage claims.
My wife left Indonesia and after 8 months of separation and suffering our family is reunited in Germany. I shall soon publish more updated information here.

Since June 15, my wife Sang Ayu Made Karnasih was in Kerobokan prison while there is a court case against her as legal owner of cv. Candi Internet for preparing to operate an ISP business presumably without license from authorities in Jakarta and for operating vSat equipment which was purchased from a Jakarta based distributor and which is wideley used in Indonesia, but has not been certified by authorities in Jakarta.
The district court of Denpasar, represented by presiding judge Nyoman Karma, sentenced Sang Ayu on September 5 to five month of prison and found her guilty for "operating uncertified telecommunications equipment".
The charges regarding operating ISP services without license have been dropped for "lack of evidence".
Right after the verdict prosecution filed a complaint as they claimed the sentence was not fair and should be 10 month of prison as requested by their final statement.
Our lawyer also filed a complaint and appealed at Bali High Court. Sang Ayu has been released from prison on October 1 and is currently under house arrest.
I was forced to leave Indonesia end of July 2005, together with our small child, because police threatened to arrest me for supposedly "damaging their good names" by reporting them to the Government of Indonesia in April 2005 (KPK) and by publishing on the web.
These people destroyed not only our business, they violated our basic human rights and separated my family by force.

Bali Police started terrorizing us before we ever started any ISP services.
Our business was and is licensed, while many unlicensed ISP's are providing services on Bali and continue to do so without ever being investigated legally.
The charge regarding "operating uncertified equipment"
was invented in January 2005, three month after the same equipment was confiscated on October 23, 2004, as "evidence for unlicensed ISP operations".
And this is a very cynical charge, as most telecommunications equipment currently being used in Indonesia is not certified. This also applies to most handphones being sold in Indonesia.
As our family business cv. Candi Internet has been destroyed by terrorists inside Bali's legal system, we shall not be able to ever provide the superior and competitive broadband internet access we promised to provide.
Therefore we suffer not alone, but the public of Bali, everyone on Bali who uses the Internet, is a victim of the extortion conducted against us, all of you will continue to pay too much for services that should be better and for bandwidth that is too small for serious usage of the internet.

Since
October 23, 2004, cv. Candi Internet has
been accused by Bali police to provide unlicensed
ISP services. This is not true!
My
wife and my business has been victimized,
criminalized and blackmailed by police officers
and prosecutors for more than 5 months.

started ISP business to date
When they asked for
cv. Candi Internet's ISP license, police
has been shown a notarized exclusive franchise
agreement between PT. Pasifik Lintas Buana
(VIPNET), who are holding an
operational national ISP license, and
cv. Candi Internet.
Such franchises are common in Indonesia,
IndoNet is one of the national ISPs operating
mostly through franchise partners.
On October 23, 2004,
police invaded our office and confiscated
a satellite modem plus a router worth
about US$ 8,000 by force and by threat
of arrest if we would resist their demands.
Police took our equipment just minutes
after they looked at our franchise agreement
for the first time, which they declared
being illegal.
We have been told by various lawyers that
police ignored and abused the law by sweeping
our office the way they did, by refusing
to seriously investigate the legality
of our franchise agreement, by confiscating
equipment without having any court order
and by the way investigations were conducted.
A few days after the
sweeping, Detik magazine published two
reports about this sweeping condemning
it as illegal, as they claimed amongst
other statements, that police had no right
to investigate ISP licenses without authorization
by DirJen PosTel, the Jakarta based governmental
department in charge of licensing.
Police complained with us that we informed
the media -which we did not- and told
the Bali Media plain lies about their
subjects of investigation via police PR
department on October 29.
They told us that "this was their
revenge" and we should not contact
the media again, else we would get into
real trouble.
Our lawyer unsuccessfully investigated
at Polda Bali who was responsible for
the press release.
The PR department of Polda Bali declared
they never informed the press and so did
the department of ResKrim which is responsible
for the ongoing investigations. Today, on Sunday, April 10, 2005,
Bali TV broadcasted a report
about police investigations against cv.
Candi Internet.
Two police officers made false statements
against us and the results of their investigation:
Tri Kuncoro and Idodo.
Both of them were involved from the beginning
and participated in the sweeping from
October 23.
They are members of the "Bali Cyber
Crime Squad" and well known by unlicensed
ISPs here on Bali.
Earlier this year Mr. Idodo was on Bali
TV as investigative specialist for abortion
in a popular case labelled "Kasus
Aborsi Dr. Gigi".
In January 2005, we were told by our lawyer,
that our case has been moved to the prosecutor's
office, then back to police asking them
to "find something else", as
the prosecutor admitted that the "case
was weak" but police would "loose
their face" if the case was to be
dismissed.
My lawyer informed me in March that the
case has moved to the prosecutor again
and is out of police hands now.
He said the prosecutor told him that he
was determined to bring the case to court,
but on which charges our lawyer could
not find out.
Since October 23, 2004
cv. Candi Internet was effectively blocked
from starting our new ISP business as
planned.
This is not the place or time to make
statements If there were any requests
for money from police or prosecutors.
This is a long
and sad story of law abuse, extortion
and complete lack of legal competence.
I work for cv. Candi Internet as Manager
for Business development since 2001 and
police is aware that I am the responsible
person for any and all business decisions.
But my wife Sang Ayu, who is a dedicated
mother and housewife, has been declared
the only suspect in this case.
I was called to attend police interrogation
only as a witness and only one time.
Our partner PT. Pasifik Lintas
Buana is currently establishing a branch
office on Bali and is preparing to start
ISP business here.
We are finalizing licensing of PT. CandiNet,
a new foreign investment company, scheduled
to operate in a joint venture partnership
with PT. Pasifik Lintas Buana.
